Terms & Conditions
Please read the following carefully which is applied to all projects photographed by DuniCaptures.
DEPOSIT: This agreement becomes binding upon receipt of your deposit by DuniCaptures. It is the client's responsibility to thoroughly review and understand this agreement before booking. All bookings necessitate a non-refundable deposit equal to 50% of the package cost.
COOPERATION: The Client and the Photographer agree to collaborate and communicate effectively to achieve the best possible outcome within the scope of this contract.
OVERTIME: Additional hours will be invoiced per hour, depending on the service required. Clients must notify DuniCaptures as soon as they anticipate the need for overtime services. Failure to provide timely notification may result in the unavailability of overtime services. Overtime charges will be invoiced separately from the standard service fee. Payment for overtime services is due within 5 working days of receiving the invoice. A minimum duration for overtime may apply. This duration will be communicated to the client in advance and must be adhered to. Overtime services are subject to availability and may not be guaranteed. DuniCaptures reserves the right to decline overtime requests based on scheduling constraints.
COPYRIGHT: All photographic material created by DuniCaptures remains the property of DuniCaptures unless otherwise specified. Reproduction, lending, renting, public display, broadcasting, editing, or distribution for profit or other purposes is strictly prohibited unless explicitly permitted.
DUPLICATIONS: DuniCaptures retains copies of all final edited photos for a maximum of 2 months from the shoot date, facilitating clients' orders for extra copies. This service is not intended as a backup, solely easing the process of reordering duplicates for the client's convenience. I reserve the right to edit, display, or share images in part or in full for inclusion on my website and/or social media platforms, while always respecting the privacy and preferences of my clients.
OWNERSHIP: DuniCaptures reserves the right to withhold any materials in the event of outstanding balances. No refunds will be issued if final payments are not received. Failure to settle outstanding amounts may result in legal action to recover debts and associated costs. Prior notification of such actions will be provided.
RESPONSIBILITY AND LIABILITY: While every effort is made to ensure a flawless recording of your event, in the unlikely event of complete camera failure, DuniCaptures guarantees a full refund of all payments. However, no further action can be taken against DuniCaptures as such failures are not deliberate or intentional. DuniCaptures cannot be held liable for equipment failures, power outages, camera malfunctions, media failures, transportation disruptions, or other unforeseen circumstances beyond our control. In most cases, two cameras are brought to the shoot to mitigate any potential failures.
CLIENT RESPONSIBILITIES: The client agrees to provide all the necessary information, digital assets and feedback required to complete the agreed-upon deliverables within the agreed timeframe. If the client fails to provide the necessary information within the allotted time, the work will be completed at the earliest opportunity, taking into consideration the availability of time and resources.
PROJECT COMPLETION: Under normal circumstances, the final product is expected to be completed within 10 working days of the event date. Delays may occur due to equipment issues, editing processes, maintenance, high demand, or holiday periods. In rare cases, this timeline may be extended by up to 20 working days at the discretion of DuniCaptures. Clients experiencing prolonged delays may be eligible for appropriate delay refunds. However, DuniCaptures will not be held responsible for delays resulting from client failure to provide relevant information, payments, or other project-dependent components.
